Terms of Use

These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for use of the website and related services (hereinafter referred to as "the Service") provided by the Kemono-Box Executive Committee (hereinafter referred to as "the Committee"). Users are asked to use the Service in accordance with these Terms.

Article 1 (Application)

These Terms shall apply to all relationships between users and the Committee regarding the use of the Service. Any individual rules or guidelines posted by the Committee on the Service shall constitute a part of these Terms.

Article 2 (User Registration)

For features that require registration, user registration shall be completed when the applicant applies for registration in the manner prescribed by the Committee and the Committee approves the application.

The Committee may decline to approve a registration application in the following cases and shall bear no obligation to disclose the reasons:

  • If false information is provided in the registration application
  • If the application is from a person who has previously violated these Terms
  • If the Committee otherwise deems the registration to be inappropriate

Article 3 (Prohibited Activities)

Users shall not engage in the following activities when using the Service:

  • Activities that violate laws, regulations, or public morals
  • Activities related to criminal acts
  • Activities that infringe upon the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of the Committee, other users, or third parties
  • Activities that destroy or interfere with the functionality of the Service's servers or networks
  • Commercial use of information obtained through the Service
  • Activities that may interfere with the operation of the Committee's services
  • Unauthorized access or attempts thereof
  • Collecting or accumulating personal information of other users
  • Using the Service for fraudulent purposes
  • Activities that cause disadvantage, damage, or discomfort to other users or third parties
  • Impersonating other users
  • Advertising, promotion, solicitation, or business activities on the Service not authorized by the Committee
  • Activities that directly or indirectly provide benefits to anti-social forces in connection with the Committee's services
  • Any other activities deemed inappropriate by the Committee

Article 4 (Suspension of the Service)

The Committee may suspend or interrupt all or part of the Service without prior notice to users if it determines that any of the following reasons exist:

  • When performing maintenance, inspection, or updates to the computer systems for the Service
  • When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  • When computers or communication lines are stopped due to an accident
  • When the Committee otherwise determines that provision of the Service is difficult

The Committee shall not be liable for any disadvantage or damage incurred by users or third parties due to suspension or interruption of the Service.

Article 5 (Intellectual Property Rights)

All intellectual property rights related to the Service belong to the Committee or those who have licensed such rights to the Committee. The license to use the Service under these Terms does not constitute a license to use the intellectual property of the Committee or its licensors.

Article 6 (Disclaimer of Warranties and Limitation of Liability)

The Committee does not warrant, either expressly or implicitly, that the Service is free from defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, and infringement of rights).

The Committee shall not be liable for any damages arising from the Service to users, except in cases of intentional misconduct or gross negligence on the part of the Committee. However, this disclaimer shall not apply if the contract between the Committee and the user regarding the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act.

Article 7 (Changes to the Service)

The Committee may change, add to, or discontinue the content of the Service with prior notice to users, and users shall consent to this.

Article 8 (Changes to the Terms of Use)

The Committee may modify these Terms without obtaining individual consent from users when it deems necessary. Unless otherwise specified by the Committee, the revised Terms of Use shall take effect from the time they are posted on this website.

Article 9 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.

In the event of any dispute arising in connection with the Service, the court having jurisdiction over the location of the Committee shall have exclusive agreed jurisdiction.
